More detail needed following CMA Block Exemption recommendations, IAAF says

Competition and Market Authority (CMA) final Motor Vehicle Block Exemption Order (MVBEO) recommendations have yet to explain how access to in-vehicle data could be provided, the Independent Automotive Aftermarket Federation (IAAF) has warned.

The federation said the CMA has listened to “many of the main arguments” outlined by the IAAF but say more detail is now needed.

IAAF chief executive, Mark Field said: “On first reading of the CMA’s final MV-BEO recommendations, it’s clear and positive that they have listened and noted many of the main arguments outlined by IAAF/UK AFCAR, but the recommendations have yet to explain how the key issue of access to in-vehicle data could be provided.

“There are also many references in the report to EU related requirements, and we will monitor these closely, so as to avoid regulatory divergence.

“The question of what secondary vehicle type approval legislation will exist within the UK is still very much open.

“There is a six-year period while the EU and the CMA wait and see what the impact on the aftermarket will be, but this is also related to what other legislation will be introduced.”

The CMA recommended that the existing Motor Vehicle Block Exemption (MVBER) should be replaced with an updated UK-specific Motor Vehicle Block Exemption Order (MVBEO) and stay in place until 2029.

Its report said independent repairers must be allowed to “continue to exert vital competitive pressure on authorised repairers” to ensure consumers enjoy choice in provision and prices, adding: “These operators can only continue to exert such pressure if they have access to key inputs such as spare parts, tools, training, technical information and in-vehicle generated data.”
